- Purpose and scope
1.1 AjmanPay Digital Wallet (“AjmanPay”) is an online digital wallet payment solution issued by First Abu Dhabi Bank PJSC (“FAB”, the “Bank”, “We”) and operated by Magnati sole proprietorship LLC “Magnati” in compliance with the Stored Value Facilities regulation (“SVF”) issued by the Central Bank of the United Arab Emirates (“CBUAE”) to allow AjmanPay users to perform digital payments and transactions using their own AjmanPay.
1.2 IT IS IMPORTANT THAT YOU READ AND UNDERSTAND THESE TERMS AND CONDITIONS BECAUSE BY REGISTERING OR USING YOUR ELIGIBILE AJMANPAY YOU WILL INDICATE YOUR ACCEPTANCE OF, AND ADHERENCE TO, THESE TERMS AND CONDITIONS, AND YOU FURTHER AGREE THAT YOU ARE BOUND BY THESE TERMS AND CONDITIONS.
1.3 THESE TERMS AND CONDITIONS GOVERN YOUR ACCESS TO YOUR ELIGIBLE AJMANPAY AND THE LEGAL AND CONTRACTUAL RELATIONSHIP BETWEEN THE BANK AND YOU (“THE CUSTOMER” OR “THE USER”) IS DETERMINED BY THESE TERMS AND CONDITIONS.
1.4 IF YOU ARE ACCEPTING THESE GENERAL TERMS AND CONDITIONS ON BEHALF OF A CORPORATE ENTITY, YOU REPRESENT AND WARRANT TO FAB THAT YOU ARE DULY AUTHORIZED TO DO SO AND THAT YOU HAVE THE NECESSARY AUTHORITY TO BIND YOUR RESPECTIVE CORPORATE ENTITY TO THESE GENERAL TERMS AND CONDITIONS.
1.5 IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS, DO NOT SELECT THE TERM “ACCEPT”.
- Eligibility and Features of AjmanPay
2.1 AjmanPay is available to individuals who are registered users. If you have already successfully completed the registration process for the AjmanPay, opened an online account and identified yourself using UAE PASS (the UAE’s secure digital identity and signature solution) then, upon accepting these Terms and Conditions, you will be entitled to access and use AjmanPay.
2.2 You represent and warrant that the registration information supplied or made available to FAB when completing the registration process for the AjmanPay is and remains true, accurate and not misleading.
2.3 It is your responsibility to treat your registration and login information relating to the AjmanPay as secret and confidential. The Bank is not responsible for any use or misuse of your registration or login information (and resulting access to AjmanPay) arising from your failure to keep your registration or login information safe and confidential. If you know or suspect that anyone, other than you, knows your registration or authentication credentials or the device you use to access AjmanPay services is lost, stolen, compromised in any way or have been subject to unauthorized use of access, please notify FAB immediately.
2.4 As a user of AjmanPay, you may create multiple wallets (“Wallet(s)”) within AjmanPay and transfer funds between your digital wallets. You may also make payments to the Ajman government entities.
2.5 AjmanPay facilitates payments in UAE dirhams only. To transfer UAE dirhams
to your digital wallet(s), you can link your debit or prepaid cards or bank accounts held with FAB
or other financial institutions to your AjmanPay account. FAB may not permit the
addition of a card to AjmanPay or may remove, suspend and cancel your access
to the AjmanPay at any time if the Bank reasonably consider it necessary or
prudent to do so or suspects that there may be fraud associated with the card or for any
other reason determined by the Bank in its sole discretion. For the avoidance of doubt, these
Terms and Conditions do not apply to the use of any other cards or accounts that you may
hold.
2.6 When accessing AjmanPay, you will be authorised to:
(A) load your digital wallet(s) provided that the maximum loaded value does not, at any time,
exceed the maximum limits as prescribed by the Bank from time to time;
(B) make purchases of Ajman Government services using your digital wallet(s) wherever
this method of payment is accepted; and
(C) transfer funds from your digital wallet to other AjmanPay users wallets (to the extent permitted by FAB); and
(D) withdraw and redeem funds from your digital wallet(s) to a UAE bank account in your name.
- Availability of your AjmanPay Digital Wallet
3.1 FAB does not guarantee that AjmanPay will always be available or uninterrupted. In addition to any other rights FAB has under these Terms and Conditions, it may suspend or withdraw or restrict the availability of all or any part of AjmanPay from time to time, for example for business and operational reasons. FAB will try to give you reasonable notice of any suspension or withdrawal of AjmanPay.
- System requirements
4.1 You acknowledge that:
(A) Your digital wallet is accessed through AjmanPay and so you will need to use a browser on your device that is supported by AjmanPay.
(B) You will be unable to execute transactions or otherwise use your digital wallet if, for whatever reason, you are unable to login to your AjmanPay account;
(C) FAB is not responsible or liable for your inability to use your digital wallet as a result, directly or indirectly, of defects or malfunctions occurring in respect of your device;
(D) If your digital wallet is accessed or used on a jail-broken or rooted device, we shall not be liable for any loss of or destruction, damage, alteration or unauthorised access to files, information or data on your device or the corruption or disablement of your device caused directly or indirectly by the jail-breaking or rooting of your device;
(E) An internet connection is required to use your digital wallet and FAB does not control the coverage, availability or service provided by your Wi-Fi or mobile service provider; and
(F) FAB is not responsible for any charges that you may incur from third parties with respect to your use of your digital wallet, including without limitation any data charges or internet access fees.
- Licence to use AjmanPay
5.1 For as long as you comply with these Terms and Conditions, you are granted a non-exclusive, non-transferable, non-sub-licensable, revocable, limited license to access and use AjmanPay for the purposes described in, and in accordance with, these Terms and Conditions.
- Restrictions on the use of AjmanPay
6.1 You must not use AjmanPay except as authorized by these Terms and
Conditions or as otherwise authorized in writing by FAB. In particular, you must:
(A) not use AjmanPay for any illegal or unauthorised purpose or in a manner
that could damage or cause risk to the Bank’s business, reputation, personnel,
customers, facilities or to any third party;
(B) not introduce into or through AjmanPay any computer viruses, ‘Trojan
horse’, worm, logic bomb, back door, malware or similar item whose purpose or
possible function is to disable a computer or network or adversely affect its
performance;
(C) use appropriate virus scanning software and take other reasonable precautions in
respect of the security of your device when accessing or using AjmanPay;
(D) not modify, decompile, reverse-engineer or disassemble AjmanPay or
any part of it or remove, circumvent, disable, damage or otherwise interfere with
security-related features of AjmanPay;
(E) not impersonate any other person or access the AjmanPay account of
another person without permission;
(F) not execute transactions through AjmanPay on the basis of funds which
were obtained fraudulently or for a fraudulent purpose;
(G) not infringe FAB’s or any third party’s intellectual property rights, rights of publicity or
privacy;
(H) not refuse to cooperate in an investigation conducted by the Bank or provide
confirmation of your identity or any other information provided by you;
(I) not use AjmanPay in any manner that could damage, disable,
overburden, or impair it or FAB’s systems, including, without limitation, by using AjmanPay in an automated manner;
(J) not remove, obscure, or alter FAB’s or any third party’s copyright, patent, trademark,
or other proprietary rights notices affixed to, contained within or accessed using AjmanPay;
(K) not sell, not rent, not license, not distribute, not publish or publicly perform or display AjmanPay or services, software or information associated with or derived from it;
(L) not use AjmanPay in a manner that FAB or any payment card network
reasonably believes to be an abuse of the payment card system or a violation of
payment card network rules; or
(M) breach these Terms and Conditions or any other agreement, policy or terms as may
be applicable pursuant to or referenced in these Terms and Conditions; and
(N) breach these General Terms and Conditions or any other agreement, policy or terms as may be applicable pursuant to or referenced in these General Terms and Conditions.
- Cancelling payments and refunds
7.1 In most cases, once a payment has been completed using AjmanPay, it shall
be deemed final and irrevocable and AjmanPay does not enable the return of funds to your Digital Wallet once you have authorised a payment to an Ajman government entity (known as a “chargeback”). Your entitlement to cancel a payment to an Ajman government entity or to claim a full or partial refund of any payment you make to an Ajman government entity will be subject to the terms and conditions of the relevant Ajman government entity you have paid.
7.2 An Ajman government entity may agree to refund an amount to your digital wallet by:
(a) notifying FAB and processing the refund using functionality provided by the Bank; or
(b) using the government entity’s own refund procedure.
7.3 You acknowledge that the Bank has no obligation to provide any refund functionality or to honour any refund request it receives from any Ajman government entity.
7.4 You further acknowledge that the Bank is not responsible or liable for any refund processed
using any government entity’s refund procedure.
7.5 Notwithstanding clauses 7.1 and 7.2, the Bank reserves the right, at its sole discretion, to
cancel or reverse a payment in certain circumstances following a request (for instance, on
the basis of a manifest error or on the basis of fraud and provided that the government entity
has not redeemed the funds and the request to reverse the payment is made within 90 days
of the erroneous or unauthorised payment date.
- Intellectual property rights
8.1 All rights in the know-how, trademarks, trade names, patents, copyrights, design rights
(whether registered or unregistered), (such as database rights), and all other intellectual
property rights subsisting in or arising in connection with AjmanPay (the
“Intellectual Property”) are, and shall remain, the property of FAB and/or its licensors.
8.2 You shall not acquire any proprietary rights in such Intellectual Property and agree not to
infringe or challenge FAB’s
and/or its licensors’ rights in the Intellectual Property nor do or permit anything to be done which may be detrimental to the Intellectual Property or which may be inconsistent with or damage the reputation of FAB.
and/or its licensors. You agree to inform the Bank immediately if you become aware of any third-party activity which
infringes the Intellectual Property.
8.3 You shall indemnify the Bank from and against any losses, damages, costs, charges,
expenses and any other liabilities (including, without limitation, reasonable legal fees),
incurred or awarded against the Bank as a result of, or in connection with, your use of the
Intellectual Property in breach of these Terms and Conditions.
- Personal data protection
9.1 By using AjmanPay, you agree and authorize FAB and Magnati to processing personally identifiable information relating to you and transaction records which it may obtain, receive, or generate in connection with these Terms and Conditions and/or your use of AjmanPay in accordance with applicable data protection and privacy laws.
9.2 FAB is dedicated to protect and respect its customer’s privacy in accordance with our privacy policy and the manner in which FAB collects, uses, stores, shares and protects the customer’s personal data, as well as the customer’s rights with respect to such personal data, are explained in more detail in the Privacy Statement which can be found at: https://www.bankfab.com/en-ae/privacy-policy. You confirm that you have read, understood
and accepted the terms of the FAB Privacy Policy.
- Limitation of liability
10.1 All users of AjmanPay acknowledge that AjmanPay provides a
platform that facilitates and allows you to initiate transactions with merchants who are Ajman government entities and pay for government services. Government entity merchants
will be responsible for the services they provide and that are paid for using AjmanPay, and for any support, refunds, and any other ancillary services they provide in respect
of those services. Any liability of the Bank resulting from any Ajman government services, or any
inaccurate fees are expressly excluded.
10.2 You acknowledge that:
(A) information technology and telecommunications systems are not error-free and AjmanPay is provided "as is", "as available" and “with all faults”;
(B) the Bank hereby expressly disclaims any and all warranties, conditions, guarantees,
representations and statements with respect to AjmanPay, express or
implied, including but not limited to, any warranties of condition, quality, durability,
performance, accuracy, reliability, merchantability or fitness for a particular purpose;
(C) any functionality enabling funds to be deposited into a digital wallet from a bank account is
dependent on and subject to the operation of the Funds Transfer System operated
by the UAE Central Bank (the “Central Bank”);
(D) no industry standard or practice, including without limitation the Payment Card
Industry Data Security Standard (PCI DSS) and Payment Application Data Security
Standard (PA DSS), shall form part of the obligations of FAB under these Terms and
Conditions; and
(E) although FAB endeavours to ensure that AjmanPay is free from any
viruses or other malicious or harmful content, and to the extent permitted by the law,
the Bank does not accept any liability for errors, delays, or damage to your computer
or device as a result of using AjmanPay. Likewise, although the Bank
takes steps to protect any information that you provide via AjmanPay,
we cannot guarantee the security of your data transmitted to it. In this regard, it is
your responsibility to ensure that you have up to date antivirus software, or any other
necessary equipment in order to use AjmanPay safely and to avoid
anything that may damage or harm your computer or device.
10.3 Subject to clause 10.4, and to the extent permitted by the law, the Bank excludes liability,
whether in contract, for negligence, for breach of statutory duty or otherwise, for any direct
loss and any loss of profits, business, revenue, data, goodwill or anticipated savings, or for
indirect or consequential loss or damage which may arise out of or in connection with your
use of, or inability to use, AjmanPay.
10.4 You acknowledge that neither party excludes liability for:
(A) death or personal injury to the extent that the same arises as a result of its own
negligence or the negligence of its personnel (as applicable); or
(B) any other type of loss for which liability cannot be excluded under applicable law.
10.5 You shall indemnify FAB from and against any losses and liabilities (including, without
limitation, reasonable legal fees), incurred or awarded against FAB as a result of, or in
connection with, your use of AjmanPay and/or breach of these Terms and
Conditions.
- Third party websites
11.1 At times, AjmanPay may also link to, or incorporate information from, other third-party websites (“Linked Websites”).
11.2 You acknowledge that the Linked Websites are not under FAB’s control and the Bank is not responsible for any Linked Websites. Any such links and/or information from Linked Websites are solely for your convenience or information and does not imply or represent FAB’s endorsement of or an association with the website’s operator.
11.3 When you access a Linked Website, you do so at your own risk. It is your responsibility to review the terms and conditions that apply to the Linked Websites. Any claims you might have with respect to the Linked Websites are against the operator of the website and not against FAB.
- Term, termination, and suspension
12.1 These Terms and Conditions will apply and become binding once you select the term “Accept”.
12.2 In addition to its other rights under these Terms and Conditions, you acknowledge that FAB may, without notice, terminate or suspend your access to AjmanPay whenever it deems such action necessary in its absolute discretion and without liability to you or to any third party. Upon such termination or suspension, you agree to immediately stop using AjmanPay. These remedies are without prejudice to any other remedies which FAB may have under applicable law.
12.3 If FAB terminates your access to AjmanPay, your wallet(s) will be suspended.
12.4 If your access to AjmanPay is terminated or you submit a request to close your AjmanPay account (or a specific Wallet within your account), then in each case any remaining funds in your digital wallet(s) may be withdrawn and transferred to a UAE bank account in your name. Once your digital wallet(s) has a zero balance and no outstanding pre-approved transactions, your AjmanPay account will be closed (or, if you requested to close a particular digital wallet, that same digital wallet will be closed).
12.5 The rights of termination and suspension in this clause may be exercised without the order
of any court or other judicial authority.
12.6 If these Terms and Conditions are terminated or you are no longer using AjmanPay, these Terms and Conditions may no longer apply. However, any provisions of these
Terms and Conditions which by their nature should continue to apply after termination will
do so. This includes, without limitation, all limitations on liability, choices of law and judicial
forum and intellectual property protections and licenses.
- Death or loss of legal capacity
13.1 If we are notified of your death or loss of legal capacity, we will be entitled to suspend your
digital wallet(s). Any balance remaining in your digital wallet(s) will be dealt with at the absolute
discretion of the Bank in accordance with applicable laws and regulations. You agree that
you and your legal heirs and administrators (as the case may be) will not hold the Bank
liable for any loss, damage or expenses arising out of or in connection with the remaining
balance in your digital wallet(s) or the closure of your AjmanPay account.
- Changes to the Terms and Conditions
14.1 You agree that FAB may make operational changes to AjmanPay at any time,
including by changing the minimum specifications of the systems or devices required for
access to them. You acknowledge that the Bank will use reasonable endeavours to provide
notification of material changes to AjmanPay by notifying you in accordance with
these Terms and Conditions.
14.2. You agree to the Bank varying these Terms and Conditions at any time by giving reasonable notice to you as per applicable laws and regulations. Notice of any such amendments shall be given by the Bank in any manner the Bank deems sufficient to bring notice of the amendments to the attention of the Customer or the User, including (without limitation) by uploading the amended Terms and Conditions to the Bank’s website. You hereby acknowledge and agree that the period of notice of a variation may vary depending on the nature of the variation, however, in all cases, the Bank shall comply with applicable law when implementing any variation, including as to the period of notice provided. In all cases, such amendments will be subject to the approval of the Ajman Government. Any amendments made by the Bank in accordance with this clause shall be effective from the date specified by the Bank. By continuing to access or operate the AjmanPay, you shall be deemed to have accepted the Terms and Conditions in force at the relevant time. If you do not agree with any change made by the Bank to AjmanPay or these Terms and Conditions, your sole and exclusive remedy is to stop your use or access of AjmanPay.
- Sub-contracting and assignment
15.1 You acknowledge that, to the extent permitted by law, FAB may subcontract, delegate, or otherwise transfer the benefit of these Terms and Conditions or any of our obligations under them to any other legal person without your consent.
15.2 You shall not, or purport to, assign, sub-contract, delegate or otherwise transfer the benefit
of these Terms and Conditions or any of your obligations under them to any other person
without FAB’s prior written consent.
- Regulatory
16.1 FAB is authorised by the Central Bank of the UAE to provide the digital payment services within AjmanPay in accordance with the Stored Values Facilities issued by the Central Bank of the UAE (the “Framework”) and AjmanPay is operated in accordance with the requirements of the Framework.
16.2 You acknowledge that, amongst other things, the Framework or the Bank, may place limits on the amount that can be funded to your wallet(s) per month, the amount that can be held in your Wallet(s), the amount of each transaction you can initiate using AjmanPay, and on your daily spending using AjmanPay.
16.3 The Framework authorises the Bank to apply the charges agreed with Ajman Government for the execution of certain transactions using AjmanPay.
- Dispute process
17.1 If you wish to file a dispute in respect of a payment made using AjmanPay, you
can do so via the Contact Centre on 600 500 201. The dispute must be submitted within 90 days of the transaction in dispute.
17.2 If the dispute in respect of a payment made using AjmanPay is found not to be
a fraud case, we will close the dispute and you will not be eligible for any reimbursement.
17.3 You will need to provide the below details for any disputes raised on transactions made
using AjmanPay:
(A) police Complaint Report;
(B) filled dispute claim form;
(C) Emirates ID Copy;
(D) passport Copy; and
(E) statement copy of the bank card used to fund your digital wallet(s).
17.4 Investigation and resolution on fraudulent transactions can take up to 180 days and we
reserve the right to reverse any interim credit provided.
17.5 We shall inform you of any such actions it takes, unless we reasonably believe that it is
prevented from doing so by law or regulation or it believes that doing so would compromise
its anti-fraud or security measures.
17.6 You acknowledge that we are under no obligation to recall funds and shall have no liability
if it is unable to partially or fully recall the funds subject to the dispute.

18.1 In the event that you are dissatisfied with AjmanPay, please reach out to the Contact Centre on 600 500 201
18.2 If you submit or provide suggestions for improving AjmanPay (“Feedback”) by contacting Ajman Government, you agree that we will be free to exercise any and all rights in the
feedback without restriction, including any obligation to attribute the feedback to you or to
compensate you in any manner whatsoever. You must not give any information that is
confidential, commercially sensitive or contains original creative work, or is the intellectual
property or proprietary property of you or another person.
- Contacting you
19.1 You agree that we may contact you by any lawful method, including by email or using the
mobile phone number you provided upon registration. If your contact details change, please
ensure your new contact details are updated without any delay using Ajman Pay mobile application.
- General
20.1 These Terms and Conditions and any dispute or claim arising out of or in connection with
them or their subject matter or formation (and any non-contractual obligations arising out of
or in connection with them) shall be governed by the laws of the United Arab Emirates.
20.2 You agree that the competent federal courts of the United Arab Emirates will have exclusive jurisdiction to hear any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter or formation (including non-contractual obligations, disputes or claims).
20.3 These Terms and Conditions shall constitute the entire agreement between the parties in
respect of their subject matter.
20.4 You acknowledge that in entering into these Terms and Conditions you have not relied on
any representation, warranty, collateral contract or other assurance (except those set out in
these Terms and Conditions) made earlier by or on behalf of the Bank. You hereby waive
all rights and remedies which, but for this clause 20.4, might otherwise be available to you
in respect of any such representation, warranty, collateral contract or other assurance.
20.5 You agree that no failure or delay by the Bank to enforce, or exercise, or any partial, single
or defective exercise or enforcement of, any right, remedy, power or privilege given to the
Bank pursuant to these Terms and Conditions shall constitute a waiver or partial waiver of
any such right, remedy, power or privilege or operate to prevent the exercise or enforcement
of any further right, remedy, power or privilege at any subsequent time.
20.6 You undertake, at the request of the Bank (unless otherwise agreed or specified in these
Terms and Conditions) execute all documents which may be necessary to give full effect to
these Terms and Conditions.
20.7 Nothing in these Terms and Conditions shall be construed as constituting a partnership or
agency between the parties hereto for any purpose.
20.8 Nothing in these Terms and Conditions shall confer, nor be intended to confer, any right or
benefit on any third party.
20.9 To the extent that the terms of these Terms and Conditions are published in English and
Arabic and there is an inconsistency between the English and Arabic versions, the English
version shall prevail.

Scope
We respect the privacy of our Users and highly value their trust in us. In this privacy statement, we explain how we collect, use, disclose, and protect your information when you access and use AjmanPay Wallet .
The policy, however, might change at any time and for any reason; FAB will send a notification to its Users informing them about the updated policy to read it and agree to it.
Additionally, we advise you and recommend to periodically check and review this page to stay informed of any updates. Using our website and/or application, or continuing to use it, means your acceptance and adherence to our Privacy Policy.
Data Collection
The type of information we collect includes personal information, derivative data, Geo-location information, mobile device access, mobile device data and push notifications.
Personal Information
While using Ajman Pay Wallet, we collect any Personally Identifiable Information (PII) such as your name and email address, which you voluntarily provide us when participating in various interactive activities such as chat, surveys, or while providing feedback, requesting information, using services and journey and logging through the Smart Pass. Your personal information will be logged and saved on our servers for the purpose of logging and tracking transactional services.
Derivative Data
We may, automatically, gather and store certain technical information while using the Ajman Pay Wallet such as the pages you have accessed and the Transactions you have made. This information is collected with the intent to understand your needs and help you, in a better way, access the information.
Payment Data
Ajman Pay Wallet provides you with the option to pay for multiple services, including water and electricity, traffic fines, among others. We do not collect or store any of the financial data such as credit card details.
Geo-Location Information
When you use AjmanPay Wallet , we request your consent to access and collect your Geo-location data. We use the location service to determine your current location and provide you with services such as map directions and route to the nearest government entity. The Geo tracking service is also used to provide you with services and information related to your geographic location.
You can disable the Geo-location tracking service, if you wish to, through the device’s settings.
Mobile Device Data
Each time you access AjmanPay Wallet , we may automatically, based on the permission you have granted, access certain features from your mobile device and collect information such as the device type you are using, the operating system running on the device model, default language used for the device, location, and network provider.
Mobile Device Access
Some of our services such as reporting incidents may require the upload of supporting documents such as images. For this kind of services, we may request your permission to access certain features from your mobile device, including camera, contacts, reminders, SMS messages, social media accounts and other features.
You can always disable the access permission at any time through the device’s settings.
Push Notifications
With the intent of facilitating your experience in availing our Services and keeping you updated, we may request to send you push notifications regarding the government services, your account or the application update. You can always disable this type of notifications by turning them off in your device’s settings.
Use and Disclosure of the Information We Collect
The information we collect will only be used to communicate to you the status of the Services Transactions you initiated and/or to assess your input to improve the content of AjmanPay application. Ajman Government will not sell, exchange or otherwise distribute the collected data for commercial or marketing purposes.
Third Party Links
AjmanPay Wallet contains links to other applications and websites. We do not bear responsibility for the content and the privacy policy of the linked applications or websites. We advise you to examine the privacy practices of each linked application or website and make your own decisions regarding the provided material in terms of accuracy, reliability and correctness.
Information Security
FAB has appropriate security measures in place to protect against the loss, misuse or alteration of information that has been posted. Access, Correction and Deletion of Information
AjmanPay Wallet will provide authenticated individuals with the personal information that has been collected on them upon request. Individuals are encouraged to correct any errors in their personal information so that the right level of interaction with the application is maintained.
